INFORMATION CLAUSE FOR COUNTERPARTIES – PROCESSING OF PERSONAL DATA IN ACCORDANCE WITH GDPR

 

WHAT IS GDPR?

GDPR: these are new EU regulations regulating the principles of personal data protection, which apply from May 25, 2018.

Our company complies with the rules set out in the GDPR.

 

Full name of the GDPR:

General Data Protection Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC.

The data administrator is responsible for the security of personal data provided and for processing it in accordance with the law.

 

WHAT PURPOSE AND ON WHAT LEGAL BASIS DO WE USE DATA FOR?

Your personal data Argus Maszyny Sp. z o.o. will use for the following purposes:

conclusion and performance of a service contract, including ensuring the correct quality of services (legal basis – art.6 par.1 lit.b GDPR) – “performance of the contract”,

fulfillment of legal obligations incumbent on our company, e.g. issuing and storing invoices or answering complaints (legal basis – art.6 par.1 letter c GDPR) – “legal obligation”,

pursuing claims arising from the contract (legal basis – art.6 par.1 lit.f GDPR) – “legitimate interest”,

marketing of own services during the term of the contract (legal basis – art.6 par.1 lit.f GDPR) – “legitimate interest”,

marketing, if you consent to the use of data for this purpose (legal basis – art.6 par.1 lit.a GDPR) – “consent”.

 

HOW LONG WILL WE USE DATA?

We will use the data for the period necessary to achieve the purposes described above. Depending on the legal basis, this will be:

Duration of the agreement,

the time of performing legal obligations and the time when legal regulations require us to store data, e.g. tax regulations,

the time after which the contractual claims will be barred,

time until consent is withdrawn.

 

WHAT ARE YOUR RIGHTS?

You can apply to our company for:

access to personal data (information about personal data being processed and a copy of the data),

correcting data when it is incorrect,

data transfer, in cases specified in the GDPR,

deleting or limiting the processing of personal data.

At the same time, we would like to inform you that regardless of the rights listed above, you can object to the processing of your data at any time, if the legal basis for the use of data is a legitimate interest. After accepting the application in this matter, we are obliged to stop processing data for this purpose.

You also have the right to lodge a complaint with the President of the Office for Personal Data Protection if you believe that the processing of your personal data violates the law. The consent granted for the processing of personal data for marketing purposes may be withdrawn at any time.

 

WHO DO WE TRANSFER YOUR DATA TO?

With all data security guarantees, we may transfer your data – in addition to persons authorized by the Data Administrator – to other entities, including:

entities processing them on our behalf, e.g. our agents and suppliers of machines related to the implementation of your order.

Your data may also be transferred to countries outside the European Economic Area, provided that the conditions set out in Chapter V of the GDPR are met.
